By accessing or using MySellerCentral in any manner, you agree to all terms and conditions herein, our Privacy Policy, and any additional policies posted in our Services.

These Terms of Use (“Terms”) govern the Agreement between you and KAS Global Commerce INC (“Company”, “we”, “us”). The Agreement covers your use of our platform, analytics, applications, websites and all other products and services (collectively, the “Services”).
If you use the Services on behalf of a company, “you” includes you and that entity, and you represent that you are an authorized representative with authority to bind the entity to this Agreement.

1. Access & Passwords
You must be at least 18 years of age to use MySellerCentral. By using the Services you confirm you meet this requirement.
To access most features you must create an account with accurate, complete information updated as necessary. Inaccurate information may result in suspension or termination.
You may log in via third-party authentication (Facebook, Google, LinkedIn, etc.). These are Third Party Platforms and we are not responsible for their systems or data.
You are solely responsible for your account activity and must keep your password secure. Notify us immediately of any unauthorized access.
2. Your Obligations
A. Subscriptions
Subscriptions auto-renew at the frequency on your subscription page (default: monthly) and your payment method is charged automatically.
To avoid future charges, cancel 2 days before the renewal date via self-serve or customer support.
Payments are non-refundable. You retain access to paid Services through the end of your current paid period after cancellation.
B. Payments
You authorize us to charge applicable fees to your payment method and retain payment information associated with your account.
Billing information must be kept current. Unpaid charges remain your responsibility even after account cancellation.
Accounts with unpaid charges over 30 days may be suspended. A 1.5% monthly late charge may apply on overdue amounts.
You are responsible for all charges under your account, including taxes and purchases by anyone who accesses your account.
C. Prohibited Uses
Harm or Misuse the Services — You may not:
Use Services in ways that damage, disable or impair platform performance
Upload viruses, malware, or harmful code
Reverse engineer, decompile, or derive source code
Resell or exploit the Services commercially
Use automated scripts or crawlers to access the site
Create derivative works from the Services
Harm the Company — You may not:
Remove or alter trademarks, logos, or proprietary notices
Portray the Company in a false, derogatory, or misleading manner
Imply any endorsement by the Company
Harm Other Users — You may not:
Restrict or inhibit other users from enjoying the Services
Post unlawful, defamatory, obscene, or fraudulent content
Send spam or unsolicited commercial messages
You must protect our Confidential Information — including the Services, documentation, and operational details — with at least the same care as your own confidential information, but no less than industry-standard efforts.
3. Our Obligations
We grant you a limited, non-exclusive, non-transferable license to access and use the Services during the term of this Agreement.
Our obligations regarding your personal information are detailed in our Privacy Policy.
We have no obligation to monitor content on the Services but reserve the right to do so and disclose information as required by law or to protect our customers.
4. Third Party Content and Services
A. Authorization
The Services may integrate with Third Party Platforms (e.g., Amazon, Google, Shopify) via APIs or browser extensions.
Company has no affiliation or endorsement from Amazon, Google, or other Third Party Platforms.
To use certain integrations you must grant us access to your third-party accounts (e.g., Amazon Seller Central).
You are responsible for reviewing Third Party Platform terms of service applicable to your use.
B. Company Data
You grant us the right to use Company Data (sales data, pricing, shipping, etc.) to provide and enhance our Services.
You represent that you have all rights and consents to share this data with us.
Company Data is not considered your confidential or personal information for purposes of this Agreement.
C. Your Customer Data
We only collect and process your Customer Data to provide Services features and functionalities.
We will never sell your Customer Data or use it for marketing purposes.
We maintain commercially reasonable security safeguards and will notify you promptly of any unauthorized access or data breach.
Aggregated, anonymous data may be used for statistical analysis and service improvement, without identifying your customers.
5. Public Postings and Licensed Materials
Content you post publicly (feedback, reviews, images, ratings) is treated as non-confidential and non-proprietary.
By posting content, you grant Company a royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute that content globally across all media.
You represent that you own or have the necessary rights to publish all content you submit.
We do not endorse user-submitted content and reserve the right to remove content that violates this Agreement without prior notice.
We are not responsible for errors in user-supplied data or independently verify truthfulness of content input into the Services.
6. Warranties and Limitations of Warranties
Important Notice
If you are not completely satisfied with the Services, your sole remedy is to cease using them.
THE SERVICES ARE PROVIDED ‘AS IS.’ WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
7. Limitations of Liability
Liability Cap
Our aggregate liability to you shall not exceed the total fees paid by you in the six months preceding any claim (or $10 if the Services are free).
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOSS OF PROFITS, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.
Your Indemnification Obligation
You agree to indemnify, defend and hold harmless the Company and its affiliates, officers, directors, agents, and employees from all losses, expenses, damages, and claims arising from: (1) your violation of this Agreement; (2) activity under your account; (3) your use of the Services; (4) your violation of third-party rights; or (5) your content or data.
8. Duration of Terms
This Agreement continues until terminated by you or by us. Key obligations survive termination.
You may terminate at any time by notifying us or cancelling your subscription as described in Section 2(A).
We may terminate immediately without notice if you breach this Agreement, or at any time by providing reasonable notice via email.
9. Modifications to Terms & Services
Modification of Terms
We may change these Terms at any time. You will be notified via email or by posting notice on the Services. Changes become effective upon receipt or posting. Continued use of the Services after notice constitutes acceptance.
Modification of Services
We reserve the right to modify or discontinue the Services at any time, including adding or removing features, without liability. Your sole remedy is to terminate your subscription.
10. Ownership
We retain all right, title and interest in the Services, including all content, software, analytics, logos, images, and look and feel.
All content on our websites is our property or that of third parties, protected by US copyright law and international conventions.
Feedback and unsolicited ideas submitted to us become our property. You forfeit intellectual property rights in any unsolicited ideas.
11. International Users
The Services are controlled and operated from within the United States.
We make no representation that the Services are available or appropriate outside the US.
International access remains subject to this Agreement and you must comply with all applicable US export laws and local regulations.
12. Arbitration and Class Action Waiver
This section contains a binding arbitration clause and class action waiver that affects your rights about how to resolve disputes with us.
Informal Process First
Before arbitration, you agree to contact us and make a good-faith effort to resolve the dispute informally.
Arbitration Election
All disputes may be resolved by binding individual arbitration before JAMS. You expressly waive trial by jury. Class arbitrations and class actions are not permitted.
Opting Out
You may opt out of this arbitration agreement by notifying us in writing within 30 days of first registering or agreeing to these Terms. Send opt-out requests to: contact@kascommerce.com with your name, address, and a clear opt-out statement.
Small Claims Alternative
As an alternative, you may bring your claim in your local small claims court if permitted by that court's rules, on an individual basis only.
13. Miscellaneous
California law governs this Agreement, except the arbitration provision which is governed by the US Federal Arbitration Act.
You may not assign your rights or obligations hereunder. Any attempt to do so is void.
This Agreement constitutes the entire agreement between you and the Company regarding the Services.
Claims must be filed within six months of when the cause of action arose or be barred.
